This agreement defines the terms for purchasing goods from the Vselekala online store located at https://vselekala.com/.

1. General Provisions

1.1. Individual Entrepreneur Tatiana Konstantinovna Burtseva (hereinafter, the Seller) publishes this agreement for the Vselekala online store.

1.2. This document is a public offer in accordance with Articles 435 and 437 of the Civil Code of the Russian Federation.

1.3. This offer defines the terms of the agreement between the Seller and the Buyer.

1.4. Any individual or legal entity that accepts this offer becomes a Buyer.

1.5. Placing and paying for an order on https://vselekala.com/ constitutes acceptance of the offer.

1.6. The Buyer accepts all terms of this offer unconditionally.

1.7. The current version of the agreement is published at https://vselekala.com/.

1.8. The online store is intended for the remote sale of goods over the Internet.

1.9. Browsing the website and selecting goods is free of charge.

1.10. All website content, including texts, images, documents, videos, and graphic materials, is the intellectual property of Individual Entrepreneur T. K. Burtseva and is protected by the laws of the Russian Federation.

Use of website materials without the right holder’s written permission is prohibited.

1.11. The online store operates in accordance with the Civil Code of the Russian Federation, Law of the Russian Federation No. 2300-1 “On Protection of Consumer Rights,” Resolution of the Government of the Russian Federation No. 2463 dated December 31, 2020 “On Approval of the Rules for the Sale of Goods under a Retail Sale Agreement,” and other applicable laws of the Russian Federation.

1.12. The Seller may amend this offer without prior notice. A new version takes effect upon publication on the website.

2. Subject of the Agreement

2.1. The Seller undertakes to provide the Buyer with access to digital goods, and the Buyer undertakes to pay for such goods.

2.2. The online store’s goods are digital goods (electronic content) provided over the Internet.

2.3. The online store offers the following categories of goods:

2.3.1. Sewing patterns — electronic drawings of pieces for making sewn products in PDF format.

2.3.2. Video master classes and Sewing Courses — educational video materials on making sewn products.

2.4. Photographs of products on the website demonstrate a possible sewing result and may differ from the result obtained by the Buyer.

2.5. The sewing patterns and educational materials are original works. The exclusive rights belong to Individual Entrepreneur T. K. Burtseva.

2.6. The Buyer is granted a non-exclusive license to use the purchased digital materials solely for personal use.

The following are prohibited:

• resale
  • distribution
  • transfer to third parties
  • publication on the Internet
  • copying for commercial use.

3. Time of Conclusion of the Agreement

3.1. The agreement is deemed concluded when the order is paid for.

3.2. By placing an order, the Buyer confirms that they are purchasing digital goods provided electronically.

3.3. The order is paid for through the YooKassa or CloudPayments payment service.

4. Characteristics of the Goods

4.1. A “Sewing Pattern”:

• is provided in PDF format for printing on A4 and A0 printers
  • is intended for self-printing
  • may contain watermarks.

4.2. “Video Master Class” and “Sewing Course” goods:

• are provided as access to video materials
  • are viewed on the website or through a provided link.

4.3. Downloading video files may be restricted.

5. Price of the Goods

5.1. The price of the goods is stated in rubles.

5.2. The Seller may change the price of the goods.

5.3. The price of paid goods may not be changed.

6. Procedure for Purchasing Goods

6.1. The Buyer places the order independently.

6.2. An email address is provided when placing an order.

6.3. The email address is used as the login for the personal account.

6.4. Access to the personal account is provided automatically.

6.5. The Seller stores purchase information in the personal account for one year.

7. Payment for Goods

7.1. Payment is made using the methods specified on the website.

7.2. Payments are accepted through YooKassa and CloudPayments.

7.3. Bank cards are accepted for payment.

8. Delivery of Goods

8.1. Goods are delivered by providing access to digital content.

8.2. Access is provided automatically after payment is confirmed.

8.3. In some cases, access may take up to 72 hours to be provided.

9. Rights and Obligations of the Parties

The Seller undertakes to:

• provide access to the purchased goods
  • not disclose Buyers’ personal data.

The Buyer undertakes to:

• provide accurate information
  • use the goods only for personal purposes
  • not distribute the materials.

10. Liability of the Parties

10.1. The Parties are liable in accordance with the laws of the Russian Federation.

10.2. The Seller is not liable for:

• technical problems on the Buyer’s side
  • inability to use the materials due to equipment characteristics
  • the result of sewing products from the patterns.

10.3. The Seller is not liable for the consequences of force majeure circumstances.

11. Refunds

11.1. The Buyer may cancel the goods before access to them is provided.

11.2. Once access to digital goods has been provided, no refund is made.

11.3. Providing a download or viewing link is considered delivery of the goods.

12. Force Majeure

The Parties are released from liability upon the occurrence of force majeure circumstances.

13. Term of the Agreement

The agreement takes effect upon acceptance and remains in force until all obligations have been fully performed.

14. Personal Data

14.1. The Buyer agrees to the processing of personal data. Consent to personal data processing is given by completing a form on the website.

14.2. Processing is carried out in accordance with the Privacy Policy published on the website.

15. Final Provisions

15.1. This agreement contains all terms of the transaction.

15.2. Rights may be transferred to third parties only with the written consent of the Parties.
